Selling Your Spanish Home? Know Your Taxes!

When you sell your property in Spain, you´ll typically encounter two main taxes:
- Plusvalía municipal (IIVTNU): This local tax goes to the town hall and is based on the increased value of the land your property sits on over time.
- Plusvalía estatal (Impuesto sobre Ganancias Patrimoniales): This national tax hits the profit you make – the difference between your original purchase price and the selling price. It´s included in your annual income tax (IRPF for residents, IRNR for non-residents). No profit, no tax!

Quick Seller´s Checklist:
Pay «Plusvalía municipal» (to the local council).
Pay «Plusvalía estatal» (on your profit to the State).
The buyer pays the Impuesto de Transmisiones y Actos Jurídicos Documentados.

Let´s zoom in on the seller´s taxes:

«Plusvalía municipal» - The Land Value Tax: This tax in Marbella, for example, looks at how many full years you´ve owned the property (max 20 years) and applies an annual percentage increase to the land´s original value:

1-5 years 2.5%
5-10 years 2.3%
10-15 years 2.4%
15-20 years 2.5%

Example: Sold after 6 years? Thats 6×2.3%=13.8%. If the land value when you bought was €50,000, the tax would be 13.8%×50,000€=6,900€.

«Plusvalía estatal» - The Capital Gains Tax:
This tax targets the profit from the sale. The «selling price» is what you get after deducting the «Plusvalía municipal» paid and any real estate agent fees (including VAT).

Selling Price Calculation:

Selling Price=Deed Value−IIVTNU−(Agent Fee+VAT)

What percentage do you pay on this profit?
Up to €6,000: 19%
€6,001 - €50,000: 21%
€50,001 - €200,000: 23%
€200,001 - €300,000: 27%
Over €300,000: 28%

Remember, this gets sorted out in your annual income tax return. There are some exemptions, like for over-65s selling their main home up to €350,000 and reinvesting it in a new main home. Since 2013, proof of payment is needed to register the sale.
